Nox Power LLC (“Nox Power,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you interact with us—including through our website, sales calls, in-home consultations, and our network of independent sales representatives.
Nox Power currently offers its services in California, Texas, Florida, Arizona, and Illinois, and may expand into additional states—including Virginia, North Carolina, Oregon, Washington, Pennsylvania, and Maryland—over time. Section 9 below describes additional rights that apply to residents of certain states with their own comprehensive privacy laws.
Please read this Privacy Policy carefully. By visiting our website, providing your information to us, or otherwise interacting with Nox Power, you agree to the terms described below. If you do not agree, please do not provide your information to us or use our services.
1. Important Note About Our Role
Nox Power is a sales and marketing company—we are not the installer, manufacturer, or contracting party for the solar or battery equipment we help you find. Nox Power sells residential solar systems and battery storage products on behalf of independent, third-party installation and manufacturing companies (each, an “Installer Partner”).
The specific Installer Partner involved in your purchase will depend on your location, the product, and other factors, and will be identified to you during the sales process. When you purchase a system through Nox Power:
- Nox Power's role is limited to sales: presenting products, generating quotes, and helping you get started.
- The applicable Installer Partner is the contracting party for your purchase, and that Installer Partner provides the hardware and performs the installation.
- Information you provide to Nox Power during the sales process will be shared with the applicable Installer Partner so that it can enter into a contract with you, schedule installation, and provide the equipment and related services.
Once your information is shared with an Installer Partner, that Installer Partner's own privacy policy and practices will govern its handling of your information. We encourage you to review the relevant Installer Partner's privacy policy as well.
2. Information We Collect
We collect the following categories of information:
a. Information You Provide Directly
- Contact information (name, address, phone number, email address)
- Information submitted through website forms, lead capture forms, or newsletter sign-ups
- Information provided during in-home consultations, phone calls, or sales presentations
- Property and utility information relevant to evaluating a solar/battery system (e.g., utility provider, average electric usage, roof characteristics, homeownership status)
- Financial and credit information you choose to share for the purpose of loan or financing pre-qualification
- Communications you send to us, including questions, feedback, or service requests
b. Information Collected Automatically
When you visit our website, we (and our service providers) may automatically collect certain information using cookies, web beacons, and similar tracking technologies, including:
- IP address, browser type, and device information
- Pages visited, time spent on pages, and referring/exit URLs
- Approximate geographic location (based on IP address)
- Interaction with forms, ads, and marketing emails
We use tools such as Google Analytics and similar advertising/analytics platforms to understand how visitors use our site and to improve our marketing. You can control cookies through your browser settings; see Section 8 below for more on your choices.
c. Information We Do Not Collect
Nox Power does not process or store payment card information (no PCI-scope data such as credit/debit card numbers). Any payments or financing are handled directly between you, the applicable Installer Partner, and/or third-party financing partners, subject to their own data handling practices.
3. How We Use Your Information
We use the information we collect to:
- Evaluate your eligibility for, and interest in, a residential solar and/or battery system
- Generate quotes and proposals
- Connect you with the applicable Installer Partner to enter into a sales contract and arrange installation
- Connect you with third-party financing or lending partners if you are interested in financing options
- Communicate with you about your inquiry, quote, or account, including by phone, text, or email
- Improve our website, marketing materials, and sales processes
- Conduct internal analytics, reporting, and quality assurance
- Comply with applicable laws, regulations, and industry requirements
- Detect, investigate, and prevent fraud or misuse of our services
4. How We Share Your Information
We share information with the following categories of recipients:
a. Installer Partners
We share your information with the applicable Installer Partner so that it can serve as the contracting party for your purchase, provide hardware, and perform installation. Each Installer Partner's use of your information once received is governed by that Installer Partner's own privacy policy.
b. Financing and Lending Partners
If you express interest in financing your purchase, we may share relevant information with third-party financing or lending companies so they can evaluate and process financing applications. These partners will handle your information under their own privacy policies.
c. Independent Sales Representatives
Much of our sales force consists of independent contractors rather than direct employees. These independent representatives may have access to your contact and lead information in order to follow up with you, present products, and complete the sales process. Independent representatives are contractually required to handle your information appropriately and use it only for purposes related to your potential or actual purchase.
d. Marketing Partners and Service Providers
We may share information with marketing partners, lead-generation companies, advertising platforms, and other vendors who help us operate our business, such as website hosting providers, CRM and email service providers, and analytics providers.
e. Legal and Safety Reasons
We may disclose information when required by law, regulation, legal process, or government request, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
f. Business Transfers
If Nox Power is involved in a merger, acquisition, financing, or sale of business assets, your information may be transferred as part of that transaction, subject to standard confidentiality protections.
We do not sell your personal information for money. We do, however, share certain information—such as contact and lead details—with financing and marketing partners as described above, which some state privacy laws define broadly as a “sale” or “sharing” of personal information regardless of whether money changes hands. No mobile information will be shared or sold to third parties or affiliates for marketing or promotional purposes. All categories outlined in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties under any circumstances.
End users may opt out of receiving further messages at any time by replying STOP or request additional information by replying HELP. Message frequency may vary, and message and data rates may apply.
Section 9 further explains your rights to opt out of this where applicable.
5. Cookies and Tracking Technologies
Our website uses cookies and similar technologies, including analytics tools (such as Google Analytics) and advertising/retargeting pixels, to:
- Understand how visitors use our website
- Measure the effectiveness of our marketing campaigns
- Deliver relevant advertising on other websites and platforms

When information is no longer needed, we take reasonable steps to securely delete or anonymize it.

We use reasonable administrative, technical, and physical safeguards designed to protect your information against unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
8. General Consumer Choices
Regardless of your state of residence, you may:
- Opt out of marketing emails at any time using the unsubscribe link included in our emails
- Ask to stop receiving marketing calls or texts by contacting us using the information in Section 13
- Adjust your browser settings to block or limit cookies
Residents of certain states also have additional, legally-defined rights described in Section 9 below.
9. State-Specific Privacy Rights
A number of states have enacted their own comprehensive consumer privacy laws that give residents specific rights regarding their personal information. Below is a summary of the laws currently applicable in states where Nox Power operates or plans to operate.
This summary is general in nature, is current as of the “Last Updated” date above, and is not a substitute for the full text of each statute. State privacy laws change frequently, and applicability to a specific business often depends on revenue and data-volume thresholds. Nox Power will monitor which thresholds and obligations actually apply to its operations.
a. California – CCPA/CPRA
California residents are protected by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA/CPRA”). Subject to certain exceptions and applicability thresholds, California residents may have the right to:
- Know what personal information we have collected, used, disclosed, and/or sold or shared about them
- Delete personal information we have collected, subject to certain exceptions
- Correct inaccurate personal information
- Opt out of the “sale” or “sharing” of personal information (including for cross-context behavioral advertising)
- Limit the use and disclosure of sensitive personal information
- Not be discriminated against for exercising any of these rights
California residents may submit a request by contacting us using the information in Section 13. We will verify your identity before responding and will respond within the timeframes required by law. Nox Power honors the Global Privacy Control (“GPC”) signal as a valid request to opt out of the sale/sharing of personal information for browsers and devices that send it.
b. Texas – TDPSA
Texas residents are protected by the Texas Data Privacy and Security Act (“TDPSA”). Subject to certain exceptions, Texas residents may have the right to:
- Confirm whether we are processing their personal data
- Access, correct, or delete their personal data
- Obtain a portable copy of their personal data
- Opt out of the sale of personal data, targeted advertising, or certain profiling
The TDPSA applies to businesses conducting business in Texas or targeting Texas residents, without a minimum revenue threshold for most provisions. Texas residents may submit requests using the contact information in Section 13, and Nox Power honors GPC opt-out signals for Texas residents as required by law.
c. Florida – FDBR
Florida residents may be protected by the Florida Digital Bill of Rights (“FDBR”), which applies to larger businesses meeting certain revenue and data-processing thresholds (including businesses with significant global gross annual revenue, among other criteria). Where applicable, the FDBR provides Florida residents with rights similar to those described above, including the right to confirm, access, correct, and delete personal data, and to opt out of the sale of personal data and targeted advertising.
d. Arizona and Illinois
As of the date of this Policy, Arizona and Illinois have not enacted comprehensive consumer privacy laws comparable to California's or Texas's. However, Illinois has specific laws addressing biometric information (the Biometric Information Privacy Act) and other targeted privacy topics that may apply depending on the type of data collected. Nox Power does not collect biometric data in the ordinary course of its sales activities.
e. Virginia – VCDPA
Virginia residents may be protected by the Virginia Consumer Data Protection Act (“VCDPA”), which provides rights to access, correct, delete, and obtain a copy of personal data, and to opt out of targeted advertising, the sale of personal data, and certain profiling.
f. Exercising Your Rights
To exercise any applicable state privacy right described above, please contact us using the information in Section 13. We will need to verify your identity before processing certain requests (such as access or deletion) and will respond within the time periods required by applicable law. You may designate an authorized agent to submit a request on your behalf where permitted by law.
10. Children's Privacy
Our services are intended for adults and are not directed to children under the age of 18. We do not knowingly collect personal information from children. If we learn that we have inadvertently collected information from a child, we will take steps to delete it.
11. Third-Party Links and Services
Our website and communications may contain links to third-party websites or services, including those operated by our Installer Partners or financing partners. This Privacy Policy does not apply to those third-party sites, and we encourage you to review their privacy policies separately.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, our footprint in new states, or for other operational, legal, or regulatory reasons. The “Last Updated” date at the top of this policy indicates when it was most recently revised. Your continued interaction with us after changes become effective constitutes acceptance of the revised policy.
